PREAMBLE

The company ADS FORMATION ET PRODUITS, a subsidiary of the IEVA GROUP, a simplified joint-stock company with a single shareholder and a capital of €4,000, registered with the Paris Trade and Companies Register under number 753 285 808, and whose registered office is located at 87 Rue Réaumur, 75002 Paris, operates the website IOMA PARIS accessible at: www.ioma-paris.com (hereinafter referred to as "the Site").
Our offers are exclusively reserved for private individuals, for use without resale, for delivery in Metropolitan France, including Corsica, Principality of Monaco, excluding DOM-TOM, European countries, China, Russia, North Africa.
A private individual is a natural person acting for purposes outside their trade, business, craft, industry, or profession. Resale of Products purchased through the Site is strictly prohibited.
Only individuals legally capable of entering into sales contracts for products offered by ADS FORMATION ET PRODUITS may place orders. As such, you declare to ADS FORMATION ET PRODUITS - IEVA GROUP that you have accepted the General Terms and Conditions of Distance Selling and, in order to conclude the sale, that you are of legal age and not under guardianship or conservatorship at the time of placing your order.
These General Terms and Conditions of Sale are intended to govern the terms and conditions of the cosmetic products appearing on the Site (hereinafter referred to as the "Products").
These General Terms and Conditions of Sale are available online at the Site's main address, downloadable, printable and prevail over any other form of reproduction.
ADS FORMATION ET PRODUITS - IEVA GROUP reserves the right to modify these General Terms and Conditions of Distance Selling at any time by publishing a new edition which will be applicable to any order placed after its first online publication on the Site.

1. Order

1.1. Placing the Order

1.2. Order Confirmation

The Order constitutes acceptance of the price, the characteristics of the Products listed on the Site as well as the conditions of delivery of the Products, it being understood that the Products are offered for sale within the limits of available stocks.
Before definitively validating your Order, you will be asked to declare that you have read the following provisions and expressly accept their terms.
To finalize your order, you will be prompted to click the "Confirm my order" button, which will redirect you to the secure online payment page. By clicking "Confirm," you accept the entire order. (This action constitutes validation of the entire order.)
Once we receive your order, we will confirm acceptance of your order and shipment of your products by email as soon as possible.
At the time of placing your order, information regarding product availability is provided. Errors or changes may exceptionally occur, particularly during peak periods such as Easter, Mother's Day, Christmas, etc. In the event that a product becomes unavailable after you have placed your order, we will inform you by email as soon as possible, in which case your refund will be processed no later than 14 days after the order cancellation.

1.3. Online Ordering

When placing your first order, you will be able to create a personal account. To do so, you will be asked to enter a username and password as well as the personal data necessary to place your order, including your identity, postal address, delivery address if different, telephone number and the payment method chosen to pay for the order.
Orders are payable only by credit card, so you will need to have your card ready to check the type of card you hold and note the information on it that is necessary to finalize your order, namely: its number, its expiry date and the cryptogram on the back of your credit card.
Your username and password serve as proof of your identity and bind you to any order placed using them, subject to your right of withdrawal as defined in Article 4 of these General Terms and Conditions of Sale. They constitute an electronic signature. You are responsible for your username and password and will bear sole responsibility for any consequences arising from their use by third parties who have gained access to them, unless such access is the result of a direct fault on the part of ADS FORMATION ET PRODUITS - IEVA GROUP.
If you forget your username and personal password, or if you are concerned that a third party may have learned of them, the Site provides a function that tells you how to retrieve your username and choose a new password at any time.
Using your personal username and password, you will be able to access the Site at any time to place your Orders.
Using the same username and password, you will be able to access your personal data partially and/or completely on the other tools offered by IOMA (the various diagnostic devices in store).
It is your responsibility to carefully review the information provided and the products included in your order before final confirmation. The order process allows you to review your order to modify or correct any errors before final confirmation. ADS FORMATION ET PRODUITS - IEVA GROUP cannot be held liable for any errors you make when placing your order.

1.4. Order refusal initiated by ADS FORMATION ET PRODUITS - IEVA GROUP

In accordance with the provisions of Article L.122-1 of the French Consumer Code, ADS FORMATION ET PRODUITS - IEVA GROUP is entitled to refuse any order or to require advance payment for legitimate reasons, including in particular in the following cases:
- of outstanding invoices or insolvency,
- foreseeable problems affecting the delivery of the Products,
- inability to prove your legal capacity to purchase or your status as a private individual
- or even if Order placed in bad faith and in particular if ADS FORMATION ET PRODUITS - IEVA GROUP finds that you are trading in the Products thus purchased.

2. Price and payment

2.1. Price

The prices applied are those in effect on the day the Order is confirmed.
Prices are expressed in Euros, inclusive of all taxes, unless otherwise stated on the Site and excluding delivery costs for the Products, as indicated in article 3.1 of these General Terms and Conditions of Distance Selling.
Promotional offers and prices are valid while they are displayed on the Site, subject to availability. We accept no liability in the event of stock shortages or product unavailability.
ADS FORMATION ET PRODUITS - IEVA GROUP reserves the right to modify the prices of the Products indicated on the Site, without notice.

2.2. Order Payment

Orders are payable in Euros exclusively.
Payment for your order must be made by credit card (Carte Bleue, MasterCard, Visa, American Express), PayPal, Alipay, iDeal*, or Sofort*. You will be charged as soon as your order is validated. Cards issued by banks outside of France must be international credit cards accepted in France.
ADS FORMATION ET PRODUITS - IEVA GROUP retains ownership of the delivered Products until full payment of invoices and reserves the right to suspend delivery in the event of late payment until full settlement of the debtor account.
In the event of late payment incidents on the bank account indicated at the time of placing your Order, the sums due will bear three (3) times the legal interest rate without the need for a formal notice.

3. Deliveries – Timeframes

3.1. Delivery charges

The applicable delivery charges are those in effect on the date the order is confirmed. However, delivery charges, which are beyond the control of ADS FORMATION ET PRODUITS - IEVA GROUP, are therefore subject to change at any time, without ADS FORMATION ET PRODUITS - IEVA GROUP being held liable. The delivery charges you will be billed are indicated at the time of order confirmation.
Free delivery is offered under certain conditions, please see our Delivery and Returns section.

3.2. Delivery methods & times

ADS FORMATION ET PRODUITS - IEVA GROUP offers delivery in France, Europe and some countries on other continents (see details by country in the Delivery and Returns section), excluding the following countries: Romania, Turkey, Kuwait, Singapore, Taiwan, Vietnam, Congo, Tunisia.
For all products, deliveries will be made according to the choice of the internet user.
3.2.1. As standard, by Colissimo or Mondial Relay within 2 to 8 working days depending on the country of delivery (see details by country in the Delivery and Returns section), to the address of your choice or to a collection point.
3.2.2. Express delivery via Chronopost or UPS within 1 to 6 business days depending on the country of delivery (see details by country in the Delivery and Returns section), to the address of your choice.
These delivery times start from the date of dispatch of the order by ADS FORMATION ET PRODUITS - IEVA GROUP.

Delivery times are automatically suspended by any event beyond the control of ADS FORMATION ET PRODUITS - IEVA GROUP which results in a delay in delivery.
Furthermore, ADS FORMATION ET PRODUITS - IEVA GROUP declines all responsibility and compensation in the event of delay due to false or erroneous information that you may have provided at the time of the Order.
Customs fees may be charged by the carrier upon delivery. These fees are specific to each country and depend on the value of your order. When applicable, they are your responsibility. In the event of a failed delivery or an unclaimed package from our carriers, the package will be returned to ADS FORMATION ET PRODUITS - IEVA GROUP. Upon receipt of the package, ADS FORMATION ET PRODUITS - IEVA GROUP will inspect the products. If the products are found to be in good condition, the order will be canceled and refunded, excluding shipping costs.

3.3. Product Verification

It is your responsibility to check the number and condition of the Products upon receipt.
In case of damage or missing items, we invite you to:
- to make the usual reservations with the carrier directly on the carrier's delivery note but also at the latest within 3 (three) days following receipt of the Products, by registered letter;
- to inform us within 14 (fourteen) days of delivery by registered letter to the following address: IOMA – CUSTOMER SERVICE – 87 rue Réaumur, 75002 PARIS, keeping the invoice and the signed delivery note with your reservations.

4. Right of return (withdrawal)

You have a period of fourteen (14) calendar days from the date of receipt of the Order to withdraw if the Products do not suit you, without necessarily having to state the reason.
To exercise your right of withdrawal, go to the contact page and fill in the details relating to your return request.
In accordance with the provisions of Article L.121-21-3 of the Consumer Code, you must return the Product no later than 14 (fourteen) days after communicating your decision to withdraw.
We will refund the full amount of the purchased treatment(s) which have been returned to us provided that the products have not been opened, the protective cellophane film and packaging have not been removed or damaged, and the products have not been used.
Please note, the personalized care products MY Day and Night CREAM, MY EYE CARE, MY Serum, MY ELIXIR cannot be returned.
The IOMA quality department, responsible for inspecting returned product(s), bases its assessment on the product's condition after unpacking the return parcel. We therefore recommend using sturdy packaging to prevent any damage to the product during transport; ideally, use the original packaging. Please include the invoice for this purchase in the parcel.
We also invite you to keep proof of sending the package containing the returned Products, otherwise ADS FORMATION ET PRODUITS - IEVA GROUP regrets that, without proof of sending, it cannot reimburse any package that does not reach it.
Gifts, samples, and other accessories initially delivered must be returned with the products for sale. Otherwise, we will not be able to refund the entire order.
Subject to the foregoing, ADS FORMATION ET PRODUITS - IEVA GROUP will reimburse you by bank transfer to the account used for the Order, for the price of the returned Products and the delivery charges billed at the time of the Order, if they have already been paid, within 14 (fourteen) days of the date on which ADS FORMATION ET PRODUITS - IEVA GROUP receives and inspects the returned Products. Any return shipping costs will be borne by ADS FORMATION ET PRODUITS - IEVA GROUP only if a refund for the Products is granted. Otherwise, any return shipping costs will be your responsibility.
Return shipping costs are your responsibility.

5. Warranty – Liability

5.1 Delivery

All events, of whatever nature, beyond the control of ADS FORMATION ET PRODUITS - IEVA GROUP, such as unforeseen circumstances, force majeure, disaster, strike, administrative decision, stoppage of transport which would tend to delay, prevent the execution of the delivery, constitute by express agreement, a cause of suspension or extinction of the obligations of ADS FORMATION ET PRODUITS - IEVA GROUP at its discretion, without compensation to you.
ADS FORMATION ET PRODUITS - IEVA GROUP will inform you by any appropriate means and will proceed with the refund of the amount of the undelivered order. A new delivery may be considered under mutually agreed conditions if you wish.

5.2 Products

The Products presented on the Site comply with the regulations in force in metropolitan France. When you click on a Product while visiting the Site, the product's characteristics will be displayed to you, including its contents, main active ingredients, benefits, and beauty advice.
ADS FORMATION ET PRODUITS - IEVA GROUP reserves the right to change the items offered on the Site at any time, without any prior notice.

6. Protection of personal data

The information requested when creating your personal account is necessary for ADS FORMATION ET PRODUITS - IEVA GROUP to process your order and to offer you several specific services, including the possibility of carrying out a skin diagnosis online or with a device in the point of sale, and the collection of loyalty points.
Depending on your connection point, we may need to synchronize some and/or all of your data between different platforms, including website, apps and devices, to make it available to you during your connection.

All personal information will be collected on a system that guarantees the confidentiality of the data collected and will be accessible at any time:

All of this information, possibly supplemented by other information at the time of your order, may be processed automatically for administrative and commercial purposes. This data will be processed by IEVA GROUP in strict compliance with the law and will be kept only for as long as necessary to fulfill the purpose of the processing.

7. Intellectual Property

Regardless of the medium, all elements published on the Site, including but not limited to the graphic design, software, photos, sounds, videos, recipes, product names and packaging, are the exclusive property of ADS FORMATION ET PRODUITS - IEVA GROUP. Any use or reproduction whatsoever is strictly prohibited.

8. General Information

8.1. Applicable Law and Jurisdiction

Any dispute relating to the execution of an Order and/or the interpretation of these General Terms and Conditions shall be subject to French law.
In the event of a dispute relating to the interpretation or execution of the agreements agreed between you and ADS FORMATION ET PRODUITS - IEVA GROUP, the competent court shall be, at the plaintiff's choice and in accordance with legal provisions, either that of the place where the defendant resides, or that of the place of actual delivery of the Product(s), or that of the place of performance of the service.

8.2. Enforceability of the General Terms and Conditions of Distance Selling

In accordance with the provisions of the Law of 21 June 2004 on confidence in the digital economy and the Law of 13 March 2000 on electronic signatures, the act by which you validate your order through the computer transaction as specified on the Site constitutes an irrevocable acceptance of the General Terms and Conditions of Sale in force on the day of the Order.
The General Terms and Conditions of Distance Selling displayed on the Website thus prevail over any other terms and conditions of sale that may be contained in other documents distributed by ADS FORMATION ET PRODUITS - IEVA GROUP for the Products. The Seller's failure to invoke any provision of these General Terms and Conditions of Sale at any given time shall not be interpreted as a definitive waiver of the subsequent application of any of the general terms and conditions.

8.3. Confidentiality & IT Security

ADS FORMATION ET PRODUITS - IEVA GROUP will implement all security measures to guarantee the availability, integrity and confidentiality of the data exchanged.
For its part, ADS FORMATION ET PRODUITS - IEVA GROUP draws your attention to the need to implement all appropriate measures, such as regularly updated and properly configured firewalls and anti-virus software, to protect yourself as effectively as possible against intrusions, attacks and the spread of viruses, in order to guarantee the availability, integrity and confidentiality of information sent to the Site.

8.4. Partial disability

The invalidity of any one of the articles of these General Terms and Conditions of Distance Selling shall not render the entire General Terms and Conditions of Distance Selling invalid.
