GENERAL CONDITIONS OF DISTANCE SELLING
PREAMBLE
The company INTUISKIN France, a simplified joint stock company with capital of €2,2492,423, registered in the Grenoble Trade and Companies Register under number B 521 471 144, and whose head office is located at Parc Activillage des Fontaines, ZI Bernin 38926 Crolles Cedex, operates the IOMA PARIS website accessible at the address: www.ioma-paris.com (hereinafter referred to as "the Site").
Our offers are exclusively reserved for individuals, for use without resale, for delivery in Metropolitan France, including Corsica, the Principality of Monaco, excluding the French Overseas Territories, European countries, China, Russia, North Africa.
An individual is a natural person who acts for purposes that are outside his or her commercial, craft, industrial or professional activity. Any resale of Products purchased through the Site is strictly prohibited.
Only natural persons, legally capable of entering into sales contracts for the products offered by INTUISKIN France may place an order. As such, you declare to INTUISKIN France that you have adhered to the General Terms and Conditions of Distance Selling and, in order to conclude the sale, that you are of legal age and are neither under guardianship nor curatorship when placing your Order.
These General Conditions of Sale aim to govern the terms of the cosmetic products appearing on the Site (hereinafter referred to as the “Products”).
These General Conditions of Sale can be viewed online at the main address of the Site, downloaded, printed and take precedence over any other reproduction medium.
INTUISKIN France reserves the right to modify these General Conditions of Distance Selling at any time by publishing a new edition which will be applicable to any order placed after its first posting online on the Site.
1. Order
1.1. Placing the Order
Orders can be placed:

- by telephone: 0800 027 363 (free number from a landline)
1.2. Confirmation of the Order
The Order constitutes acceptance of the price, the characteristics of the Products listed on the Site as well as the conditions of delivery of the Products, it being understood that the Products are offered for sale within the limits of available stocks.
Before definitively validating your Order, you will be asked to declare that you have read the following provisions and expressly accept their terms.
To finalize your order, you will be prompted to click on the "Validate my order" button which will direct you to the secure online payment page. By clicking on the "Validate" button, you accept the entire order. (This action is equivalent to validation of the entire Order).
Once the order has been received, we will confirm, as soon as possible, the acceptance of your Order and the sending of your products by email.
At the time of placing the Order, information on the availability of the Products is indicated. Errors or changes may exceptionally occur, particularly during busy periods such as Easter, Mother's Day, Christmas, etc. In the event that a Product is unavailable after placing your order, we will inform you by email as soon as possible, in which case your refund will be made no later than 14 days following the cancellation of the Order.
1.3. Ordering via the Internet
When you place your first order, you will be able to create a personal account. To do this, you will be asked to enter a personal username and password as well as the personal data necessary to place your Order, including your identity, your postal address, your delivery address if different, your telephone number and the payment method used to honor the Order.
As orders are payable only by bank card, you will need to have it with you to check the type of card you hold and note the information it contains and necessary to finalize your Order, namely: its number, its expiry date and the cryptogram on the back of your bank card.
The username and personal password are proof of your identity and bind you to any Order placed through them, subject to the exercise of your right of withdrawal, as defined in Article 4 of these General Terms and Conditions of Sale. They have the value of an electronic signature. Your username and personal password are your responsibility and you alone will bear the consequences that may result from any use by third parties who have become aware of them, unless this knowledge is the consequence of a direct fault on the part of INTUISKIN.
If you forget your username and your personal password, or if you fear that a third party may have become aware of them, you have a function on the Site indicating how to proceed to find your username and choose a new password at any time.
Using your username and personal password, you can subsequently access the Site at any time to place your Orders.
Using the same username and password, you will be able to partially and/or fully access your personal data on the other tools offered by IOMA (the IOMA AMOI apps and the various diagnostic devices in store).
It is your responsibility to pay particular attention to the information provided and to the Products included in your Order before finally confirming it. The Order process system allows you to return to your Order to modify it or rectify any errors before finally confirming it. INTUISKIN cannot be held responsible for any errors on your part when placing your Order.
1.4. Refusal of the order at the initiative of INTUISKIN
In accordance with the provisions of Article L.122-1 of the Consumer Code, INTUISKIN France is entitled to refuse any order or to demand advance payment, for legitimate reasons, and in particular in the event of:
- arrears of invoice or insolvency,
- foreseeable problems affecting the delivery of the Products,
- inability to prove your legal capacity to purchase or your status as an individual
- or an Order placed in bad faith and in particular if INTUISKIN France finds that you are trading in the Products thus purchased.
2. Price and payment
2.1. Price
The prices applied are those in effect on the day the Order is confirmed.
Prices are expressed in Euros, all taxes included, unless otherwise stipulated on the Site and excluding delivery costs of the Products, as indicated in article 3.1 of these General Conditions of Distance Selling.
The promotional offers and prices that are proposed are valid as long as they are visible on the Site, within the limit of available stocks. We decline all responsibility in the event of stock shortages or unavailability of the Products.
INTUISKIN reserves the right to modify the prices of the Products indicated on the Site, without notice.
2.2. Payment of the Order
Orders are payable in Euros exclusively.
Payment for the Order must be made by credit card (Carte Bleue, Master Card, Visa Card, American Express), Paypal, Alipay, iDeal*, Sofort* you will be debited as soon as your order is validated. Cards issued by banks outside France must be international bank cards accepted in France.
INTUISKIN retains ownership of the Products delivered until full payment of the invoices and reserves the right to suspend delivery in the event of late payment and this until full regularization of the debtor account.
In the event of late payment incidents on the bank account indicated at the time of placing your Order, the amounts due will bear three (3) times the legal interest rate without formal notice being necessary.
3. Deliveries – Deadlines
3.1. Delivery costs
The applicable delivery costs are those in effect on the day the Order is confirmed. However, the delivery costs, beyond the control of INTUISKIN France, are therefore subject to change at any time, without INTUISKIN France being held liable. The delivery costs that will be invoiced to you are indicated at the time of order validation.

3.2. Delivery terms and times
INTUISKIN offers worldwide shipping, excluding the following countries: Romania, Türkiye, Kuwait, Singapore, Taiwan, Vietnam, Congo, Tunisia.
INTUISKIN undertakes to notify you by email of the status of your order the working day following your online purchase, with a tracking number.
For all products, deliveries will be made according to the Internet user's choice.
3.2.1. As standard, by Colissimo or Mondial Relay within 2 to 8 working days depending on the country of delivery (see details by country in the Delivery and returns section), to the address of your choice or to a collection point.
3.2.2. Express delivery by Chronopost or UPS within 1 to 6 working days depending on the country of delivery (see details by country in the Delivery and returns section), to the address of your choice.
These delivery times start from the dispatch of the order by INTUISKIN.
Delivery times are automatically suspended by any event beyond the control of INTUISKIN and resulting in a delay in delivery.
Furthermore, INTUISKIN declines all responsibility and compensation in the event of delay due to false or erroneous information that you may have provided at the time of the Order.
Possible customs fees may be charged by the carrier upon delivery. These are specific to each country and depend on the amount of your order. When fees apply, they are your responsibility.
3.3. Verification of Products
It is your responsibility to check the number and condition of the Products upon receipt.
In the event of damage or missing items, we invite you to:
- to make the usual reservations with the carrier directly on the carrier's delivery note but also at the latest within 3 (three) days following receipt of the Products, by registered letter;
- to inform us within 14 (fourteen) days of delivery by registered letter to the following address: IOMA – CUSTOMER SERVICE – 87 rue Réaumur, 75002 PARIS, keeping the invoice and the signed delivery note with your reservations.
4. Right of return (withdrawal)
You have a period of fourteen (14) calendar days from the date of receipt of the Order to withdraw if the Products do not suit you, without necessarily having to provide a reason.
To exercise your right of withdrawal, simply return the withdrawal form [click here to download the form] duly completed and signed to the following address: IOMA – CUSTOMER SERVICE – 87 rue Réaumur, 75008 PARIS.
In accordance with the provisions of Article L.121-21-3 of the Consumer Code, it is your responsibility to return the Product no later than 14 (fourteen) days following the communication of your decision to withdraw.
When purchasing a product for the first time, and for certain references only, INTUISKIN delivers a trial dose of the product purchased in addition to the product ordered. The trial dose will allow you to appreciate the product ordered before opening it.
We will refund you the full amount of the treatment(s) purchased which have been returned to us provided that the products have not been opened, the protective cellophane film and the packaging have not been peeled off or damaged, and the products have not been used.
Please note, the personalized treatments MY Day and Night CREAM, My EYE TREATMENT, My Serum, My ELIXIR cannot be returned.
The IOMA quality department in charge of inspecting the returned product(s), is based on the condition of the product after unpacking the return package. We therefore recommend sturdy packaging to avoid any damage to the product during transport, ideally, use the original package. The invoice corresponding to this purchase must be provided to us in the package.
We also invite you to keep proof of sending the package containing the returned Products, failing which INTUISKIN regrets that, in the absence of proof of sending, it will not be able to reimburse any package that does not reach it.
Subject to the foregoing, INTUISKIN will reimburse you by transfer to the bank account used at the time of the Order, the price of the returned Products and the delivery costs invoiced at the time of the Order, if they have already been paid, within 14 (fourteen days) following the date on which INTUISKIN France has received and inspected the returned Products. Any reshipping costs will be borne by INTUISKIN only if the refund of the products is granted. Otherwise, any reshipping costs will be at your expense.
5. Warranty – Liability
5.1 Delivery
All events, of whatever nature, beyond the control of INTUISKIN France, such as fortuitous events, force majeure, disaster, strike, administrative decision, stoppage of transport which would tend to delay or prevent the execution of the delivery, constitute by express agreement, a cause for suspension or extinction of the obligations of INTUISKIN France at its discretion, without compensation to you.
INTUISKIN France will inform you, by any appropriate means, and will proceed to reimburse the amount of the undelivered Order. A new delivery may be considered under conditions to be agreed if you wish.
5.2 Products
The Products presented on the Site comply with the regulations in force in metropolitan France. When you click on the Product while visiting the Site, the characteristic information of the Products will then be presented to you, including the capacity, the main active ingredients, the benefits and beauty advice.
INTUISKIN France reserves the right to change the items offered on the Site at any time, without notice.
6. Protection of personal data
The information requested from you when creating your personal account is necessary for INTUISKIN France to process your Order and to offer you several specific services, including the possibility of carrying out a skin diagnosis online or with a device at the point of sale, and the collection of loyalty points.
Depending on your connection point, we may need to synchronize some and/or all of your data between different platforms, including websites, apps and devices, to make them available to you during your connection.
All personal information will be collected on a system that guarantees the confidentiality of the data collected and will be accessible at any time:
• on the website by clicking on the section “My Account” / “My information” - “My Account” / “My Addresses”
• On the IOMA A MOI apps by clicking on the “My profile” section
• On the device by clicking on the “Search for existing customer” section
In accordance with the Data Protection Act of 6 January 1978, amended by the European Data Protection Regulation of 14 April 2016, you may object to the computer processing of this data and you have the right to access, port, rectify and withdraw data concerning you by connecting to the home page
• from this Site and by clicking on the “My Account” section
• on the IOMA A MOI apps by clicking on the “My profile” section
• on the device by clicking on the “Search for existing customer” section.
These sections allow you to modify your personal data yourself, at any time. To delete your personal data or to exercise your right to the portability of your data, we invite you to contact IOMA customer service, specifying the right you wish to exercise.
All of this information, possibly supplemented by other information at the time of your Order, may be subject to automated processing for administrative and commercial management purposes. This data will be processed by INTUISKIN France in strict compliance with the laws and will be kept for the time necessary for the purpose of the processing.

7. Intellectual Property
Regardless of the medium, all elements published on the Site, and in particular the graphic charter, software, photos, sounds, videos, recipes, names and packaging of the Products and without this list being limiting, are the exclusive property of INTUISKIN France. Any use or reproduction whatsoever is strictly prohibited.
8. General
8.1. Applicable law and jurisdiction
Any dispute relating to the execution of an Order and/or the interpretation of these General Conditions is subject to French law.
In the event of a dispute relating to the interpretation or execution of the agreements agreed between you and INTUISKIN France, the competent court will be, at the choice of the claimant and in accordance with legal provisions, either that of the place where the defendant resides, or that of the place of actual delivery of the Product(s), or that of the place of performance of the service.
8.2. Enforceability of the General Conditions of Distance Selling
In application of the provisions of the Law of June 21, 2004 on confidence in the digital economy and the Law of March 13, 2000 on electronic signature, the act by which you validate your order by the computer transaction as specified on the Site constitutes an irrevocable acceptance of the General Conditions of Sale in force on the day of the Order.
The General Conditions of Distance Selling appearing on the Site thus prevail over any other conditions of sale that may be contained in other documents distributed by INTUISKIN France for the Products. It may not be interpreted that the Seller has definitively waived the subsequent application of one of the general conditions by the fact that he has not availed himself at a given time of any of the provisions of the General Conditions of Sale.
8.3. Confidentiality & Computer Protection
INTUISKIN France will implement all security measures to guarantee the availability, integrity and confidentiality of the data exchanged.
For its part, INTUISKIN France draws your attention to the need to implement all useful measures, such as firewalls and anti-viruses regularly updated and correctly configured, to protect you as effectively as possible against intrusions, attacks and the spread of viruses, in order to guarantee the availability, integrity and confidentiality of the information sent to the Site.
8.4. Partial disability
The invalidity of any of the articles of these General Conditions of Distance Selling shall not entail the invalidity of all of the General Conditions of Distance Selling.
